We provide a broad range of services involving the creation and perfection of interests in intellectual property for clients across the country and world-wide. These services include the protection of trademarks, trade dress, trade secrets, copyrights, mask works and other types of intellectual property. We represent clients in the acquisition of intellectual property rights, including negotiating and drafting contractual relationships with authors, confidentiality, assignment and non-competition agreements, and in the negotiating and drafting of development, distribution and franchise agreements that utilize intellectual property. In addition, we negotiate and draft agreements for licensing intellectual property and other works of authorship, including product distribution licenses, royalty and marketing agreements and other methods of realization of profit from developed and owned intellectual property. In the course of our representation, we assist our clients in evaluating potential or current trademarks and copyrights for registration and infringement potential as well as other trademark clearances. This also includes registration of trademarks with the United States Patent and Trademark Office and applicable state agencies, maintenance of intellectual property rights, including filing of affidavits of use and renewals for state and federal trademarks, and registration of copyrights with the United States Copyright Office. We have extensive experience with the legal aspects of marketing and promoting products on both a state specific and national basis. This includes review and analysis of advertising materials and copy for infringement and compliance with applicable laws, consideration and analysis of product recovery, consumer interactions such as truth in advertising laws, and crisis management and antitrust regulations and controls. For many years we have been representing clients with full dispute resolution services for trademarks before the United States Patent and Trademark Office such as oppositions to registrations by others, petitions for cancellation of registered trademarks, and similar actions. We also assist clients in the protection of common law trademarks for new products, packaging, advertising slogans and materials, logos, graphics, sounds, and internet domain names, through the maintenance of litigation before the United States Patent and Trademark Office and, when necessary, state and federal courts. In recent years we have handled domain name disputes, and one of our attorneys-former state trial court judge Karl Fink-is frequently asked to arbitrate domain name disputes under ICANN's Uniform Domain Name Dispute Resolution Policy (UDRP). |
