We provide a full range of services relating to qualified and non-qualified employee pension and benefit plans. These include drafting and review of qualified plans and trusts, and employer specific amendments of qualified plans, including pension, 401(k) and profit sharing plans. We provide assistance to clients in submitting qualified plans to the Internal Revenue Service (IRS) for determination. Our expertise includes drafting and amending summary plan descriptions (SPDs) and plans, including forms for participant directed plans. We provide Form 5500, 5300 and other IRS compliance assistance and reporting services, including review and consideration of Qualified Domestic Relations Orders (QDROs). We also draft, review, analyze, and oversee the implementation of welfare benefit plans and employee documentation, SPDs, flexible benefit plans, medical reimbursement plans, insured health plans, dependent care plans, disability and life insurance plans, and employee assistance plans, including providing advice and representation in the area of COBRA compliance. In addition, we assist in the drafting and implementation of non-qualified deferred compensation programs, "Rabbi" trusts, "top hat" deferred compensation plans, stock option plans, stock purchase plans, severance pay plans, and we review employment agreements and similar agreements for deferred compensation impacts. Finally, we provide affirmative action planning and compliance including review and preparation of Affirmative Action Plans and required revisions and reports. |
