Not every commercial issue can be resolved in the ordinary course of business. Some disputes must move to alternative dispute resolution or full-blown litigation. We represent businesses through all stages of the commercial dispute process. We are involved in counselling our clients on facilitating a business resolution, if possible, in the early stages of a dispute. If the dispute cannot be resolved in the early stages of negotiation, we explore with our clients alternative dispute resolution processes, such as mediation or arbitration, which is often a less costly avenue for resolution of commercial issues short of full-blown litigation. We have experience in all facets of ADR, including matters handled through the American Arbitration Association, the National Arbitration Forum, the National Association of Securities Dealers. If necessary from the client's perspective, we are prepared to file and prosecute litigation in all state and federal district courts in Michigan. We also prosecute appeals, when appropriate. The firm has particular expertise in litigating franchise disputes, primarily for franchisors. A related expertise is trademark application, prosecution and litigation before the United States Patent and Trademark Office, often for our franchise clients but our intellectual property client base is much broader. In general, the firm litigates a variety of major commercial disputes, including those involving breach of contract, minority shareholder oppression, sales agency agreements, insurance coverage, real estate, banking and creditor's rights. |
